1. Acceptance of Terms

Welcome to Rhymance. By accessing and using this mobile application and its related services (hereinafter "the Application", "the Service", or "Rhymance"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use the Application.

These Terms constitute a binding legal agreement between you (the "User") and Rhymance. We reserve the right to modify these Terms at any time. We will notify you of any significant changes via the app or by email.

2. Description of Service

Rhymance is a social connection platform that allows users to meet people who share their passion for rhymes, rap, poetry, and artistic expression through words. The Application provides:

• Customizable profiles with an emphasis on rhyming skills and creativity
• Matchmaking system based on musical and style preferences
• Messaging between users who have matched
• Tools to share rhymes, lyrics, and creative content
• Premium features via subscription

The Service is designed for users over 18 years of age. By using Rhymance, you confirm that you are at least 18 years old.

3. Registration and User Account

3.1 Account Creation

To use Rhymance, you must create an account by providing accurate and complete information. You are responsible for:

• Providing true, accurate, and up-to-date information
• Maintaining the security of your password and account
• Notifying us immediately of any unauthorized use of your account
• All activities that occur under your account

3.2 Account Verification

We may request identity verification through various methods (email, phone number, photo verification). Verification may be required to access certain features or for security reasons.

3.3 One Account per User

You may only create and maintain one active account. Duplicate, fake, or fraudulent accounts will be suspended or deleted.

4. User Conduct Rules

By using Rhymance, you agree NOT to:

• Harass, intimidate, or threaten other users
• Post offensive, violent, pornographic, or illegal content
• Impersonate any person or entity
• Solicit money from other users or promote fraudulent schemes
• Share spam, unauthorized advertising, or promotional content
• Use the Application for commercial purposes without express authorization
• Collect information from other users for unauthorized purposes
• Use bots, scripts, or automation to interact with the Service
• Attempt to access other users' accounts or systems without authorization
• Violate any local, national, or international law
• Post copyrighted content without proper authorization
• Discriminate, promote hate speech, or incite violence

Rhymance reserves the right to investigate and take appropriate legal action against any user who violates these Terms.

5. User Content

5.1 Content Ownership

You retain all rights to the content you post on Rhymance (rhymes, lyrics, photos, bio, etc.). However, by posting content, you grant us a worldwide, non-exclusive, transferable, sublicensable, royalty-free license to use, reproduce, modify, adapt, publish, and distribute that content in connection with the operation of the Service.

5.2 Content Responsibility

You are solely responsible for the content you post. Rhymance does not endorse and is not responsible for user-generated content. We do not guarantee the accuracy, quality, or legality of content posted by other users.

5.3 Moderation and Removal

We reserve the right, but not the obligation, to monitor, review, remove, or modify any content that violates these Terms or that we deem inappropriate. Removal of content does not imply responsibility on our part.

5.4 Content Backup

We are not obligated to back up your content. We recommend you keep copies of any important content you post on the Application.

6. Subscriptions and Payments

6.1 Premium Features

Rhymance offers free and paid features. Premium subscriptions may include:

• Unlimited swipes
• See who has liked you
• Rewind (undo swipe)
• Boosts for increased visibility
• Additional search filters
• Access to exclusive features

6.2 Billing and Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel them before the renewal date. Prices are subject to change, but you will be notified in advance of any changes affecting your active subscription.

6.3 Cancellation and Refunds

You can cancel your subscription at any time from your account settings. Cancellations take effect at the end of the current billing period. We do not offer refunds for partial subscription periods, except where required by applicable law.

6.4 In-App Purchases

Purchases made through app stores (App Store, Google Play) are subject to the terms and policies of those platforms. Refunds for these purchases must be requested directly through the corresponding platform.

7. Privacy and Data Protection

Your privacy is important to us. The use of your personal information is governed by our Privacy Policy, which is an integral part of these Terms. By using Rhymance, you agree to the collection and use of information in accordance with that policy.

8. Intellectual Property

8.1 Rhymance Rights

Rhymance and all its content, features, and functionality (including but not limited to design, text, graphics, logos, icons, images, audio clips, downloads, interfaces, code, and software) are the exclusive property of Rhymance and are protected by copyright, trademark, and other intellectual property laws.

8.2 Limited Use

You are granted a limited, non-exclusive, non-transferable license to access and use the Application for your personal, non-commercial use. You may not:

• Modify, copy, distribute, or create derivative works
• Reverse engineer or attempt to extract the source code
• Use the Application to create competing products or services
• Remove or modify copyright or trademark notices

8.3 Trademarks

"Rhymance", the Rhymance logo, and other marks are registered trademarks of Rhymance. You may not use our trademarks without prior written permission.

9. Termination and Suspension

9.1 Termination by User

You can delete your account at any time from the app settings. Deletion is permanent and irreversible.

9.2 Termination by Rhymance

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms and Conditions
• You engage in fraudulent or illegal activities
• You receive multiple reports from other users
• For any other reason at our discretion

9.3 Effects of Termination

Upon termination of your account:

• You will lose access to all services and content
• Your profile will be deleted
• Active subscriptions will not be refunded
• We may retain certain information as required by law

10. Disclaimer of Warranties

10.1 No Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. RHYMANCE DOES NOT WARRANT THAT:

• The Service will be uninterrupted, secure, or error-free
• The results obtained will be accurate or reliable
• Defects will be corrected
• You will find specific matches or connections

10.2 User Responsibility

You are solely responsible for your interactions with other users. Rhymance does not conduct background checks. You must exercise caution and good judgment when interacting with others. We are not responsible for the conduct of any user, whether online or offline.

10.3 Personal Safety

If you choose to meet someone in person:

• Learn about the person before meeting
• Meet in public places
• Inform friends or family of your plans
• Stay sober and alert
• Trust your instincts

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RHYMANCE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AND AGENTS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, use, or other intangible losses
• Unauthorized access to or alteration of transmissions or data
• Statements or conduct of any third party on the Service
• Any other matter relating to the Service

OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU HAVE PAID TO RHYMANCE IN THE LAST SIX MONTHS, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Rhymance, its affiliates, directors, employees, and agents from any claim, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your conduct in connection with the Service
• The content you post

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Puerto Rico, without regard to its conflict of law provisions.

13.2 Arbitration

Any dispute arising out of or in connection with these Terms shall be resolved by binding arbitration, except that either party may bring an individual action in small claims court.

13.3 Jurisdiction

For any dispute not subject to arbitration, the parties agree to submit to the exclusive jurisdiction of the courts located in San Juan, Puerto Rico.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• An in-app notification
• An email to your registered address
• An update on this page with the "Last updated" date

Continued use of the Service after changes become effective constitutes your acceptance of the new Terms. If you do not agree to the modifications, you must stop using the Service and delete your account.

15. General Provisions

15.1 Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Rhymance regarding the use of the Service.

15.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

The failure of Rhymance to exercise any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

15.5 Survival

Sections that by their nature should survive the termination of these Terms will remain in effect, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.

15.6 Language

The English version of these Terms shall prevail in case of any conflict with translations into other languages.
